The resolution states the LIC owns Lakewood Airport and is “empowered to solicit businesses and industries to purchase vacant lands and property of the Township” under N.J.S.A. 40:44B-8.

The packet states the $26 million price was based on two appraisals, each “reviewed and approved by the Federal Aviation Administration.” The Federal Aviation Administration, or FAA, is the federal agency that oversees airports, including the disposal of airport land.

Under the proposed terms, CHEMED would be required to develop the site within ten years. The packet says failure to meet that requirement “will trigger a reverter clause in which case the property will be reacquired by the LIC.” A reverter clause is a contract provision that returns ownership of land to the seller if the buyer does not meet specified conditions.

The packet lists the resolution as a consent item, meaning it was scheduled to be considered together with other consent items in a single vote rather than debated individually.
